Suspect waives hearing in 2010 UPJ rape case

— A Somerset County man accused of raping a woman on the Pitt-Johnstown campus nearly three years ago is headed for court.

Campus police alleged that Kyle Timothy Pucci, 21, of Friedens, raped the woman March 9, 2010, inside a room at Hickory Hall.

He faces charges including rape by force, rape of victim who was impaired, involuntary deviate sexual intercourse by force, involuntary deviate sexual intercourse and aggravated indecent assault.

Pucci, a former UPJ student, waived his right to a preliminary hearing this week before District Judge Max Pavlovich of Richland Township.

In a criminal complaint, campus police said the woman told them she  and Pucci were drinking beer and smoking marijuana as they helped a friend of Pucci’s move off campus. Pucci and the woman later went to his dorm room and the woman, feeling tired, was lying on his bed, police said.

The woman told police Pucci sexually assaulted her and she tried to push him away.

“We’re trying to work out a resolution,” Pucci’s attorney, Michael Kuhn of Somerset, said Friday.

UPJ police withdrew sex-related charges in another case against Pucci.

Kuhn declined to comment on that case.

Pucci, of the 100 block of Oak Hill Drive, is free on bond.
