State prison guard charged after scuffle with police

NANTY GLO — A local man who is a state prison guard was arrested after he allegedly became disorderly and shoved and elbowed a borough police officer who was trying to place the accused man’s brother under arrest Sunday night.

Richard Lee Silko, 44, of the 900 block of First Street, was arraigned before District Judge Leonard Grecek of Roxbury, the on-call magistrate, and released on unsecured bond.

State police filed charges including aggravated and simple assault and public drunkenness.

The incident happened around 10:30 p.m. Sunday at the scene of an accident on McCoy Street, state police said.

Officer William Gustkey, who was treated at Memorial Medical Center in Johnstown, told state troopers he had injuries to a finger and an arm.

Silko told police that he and his brother, Robert, had been at a gun raffle at the fire hall in Nanty Glo when they learned their father had been involved in an accident nearby.

Richard Silko said he put his brother in a headlock to try to calm him down after Robert got out of control at the accident scene, according to a police affidavit.

When officers tried to handcuff Robert, Richard Silko allegedly grabbed the handcuffs and told them not to arrest his brother.

Johnstown attorney Art McQuillan, who represents Richard Silko, said, “This is an unfortunate set of circumstances, and Mr. Silko has been suspended from his job as a corrections officer at the State Correctional Institution-Laurel Highlands. He regrets the entire misunderstanding and looks forward to resolving this through the judicial system.”

McQuillan added that Silko is a 20-year veteran of the Navy and has no prior criminal record.

A preliminary hearing is scheduled for Monday before District Judge Maryann Zanghi of Vinco.

No charges have been filed at either magistrate’s office against Robert Silko.
