Threat suspect held for trial

JOHNSTOWN — A Johnstown man was ordered to stand trial on charges that he threatened to shoot three women and two children with a handgun.

Davon Marquis Joiner, 25, of the Oakhurst Homes, was ordered held for court Wednesday following a preliminary hearing before District Judge Leonard Grecek of Roxbury.

Joiner was charged with five counts each of aggravated assault, terroristic threats and reckless endangerment. He also was charged with two counts of endangering the welfare of children and one count of illegal possession of a firearm.

City police said Joiner spent Dec. 28 with his girlfriend at a home in the 300 block of McMillen Street.

When he awoke the next morning, Joiner pulled a handgun and accused someone of stealing his money, a witness said at the hearing.

“He said he was going to shoot everyone in the house if he didn’t get his money,” Heather Hamer testified.

Hamer and another witness said Joiner never pointed the gun directly at anyone.

That brought a response from defense attorney Michael Filia, who asked Grecek to dismiss the aggravated assault charges.

Assistant District Attorney Joseph Green argued that the charges should remain because Joiner did threaten to shoot the occupants.

Police said they recovered a Jennings Model 9 handgun stashed beneath a mattress in the home. The gun was loaded with one round in the chamber and several rounds in the magazine, Officer Erin Kabler testified.

Joiner was returned to the Cambria County Prison, where he is being held on $75,000 percentage bond.
