Felony counts could be refiled

EBENSBURG – The Cambria County district attorney’s office said that – although felony counts against Northern Cambria police Chief Kevin Stanek were withdrawn Monday – they could be refiled if the remaining case is not resolved.

In an unusual press release given to reporters, the DA’s office said it was concerned by “innuendoes and incorrect information being reported regarding the case.”

Stanek was charged after allegedly becoming belligerent April 12 with an officer in Susquehanna Township who had arrested his stepson for DUI. Stanek initially faced charges of aggravated assault against an officer, terroristic threats, DUI and resisting arrest. Only the last two counts remained after Monday’s preliminary hearing.

“The commonwealth voluntarily withdrew the felony charges against Chief Stanek as part of an agreement with defense counsel to have the defendant waive the remaining charges to court without having a preliminary hearing. This preliminary agreement was reached for the purpose of resolving the case without the need for a trial,” the statement said.

“If the case is not resolved, both sides agreed that the felony charges would be reinstated against Mr. Stanek. Thus, there has been no final determination regarding the charges in this case.”
