Berlin man accused of rape

BERLIN — A Berlin man was arraigned Thursday after police said he raped a mentally ill woman over a five-year period.

Gary Lee Livengood, 58, of the 500 block of Main Street, was charged with 10 counts each of rape, rape of a disabled person, aggravated assault, sexual assault and indecent assault.

In a court document, Berlin police said the alleged victim told them she was reluctant to come forward because Livengood has “lots of guns and knives.”

Livengood is accused of assaulting the woman at her apartment and later at a nursing home where she has lived since July 2007.

Police said the woman suffers from mild mental retardation, schizophrenia, renal failure and diabetes.

The incidents are alleged to have taken place from 2004 through May 19 of this year, when Livengood was no longer allowed to visit the nursing home, police said,

Police did not give her age.

The woman was taken to a hospital after one of the incidents when she suffered a mild heart attack.

It was then that she told her sister what had happened, and police were notified.

Livengood was arraigned by District Judge Douglas Bell of Meyersdale and freed on $10,000 unsecured bond.
