Altoona man resentenced to 75-150 years

HOLLIDAYSBURG — A judge has resentenced a former Pennsylvania cemetery caretaker to 75 to 150 years in prison after an appeals court ruled the man was wrongly sentenced to life in prison without parole under the three-strikes provision of Megan’s Law.

The attorney for 32-year-old David Helsel, of Altoona, says he’ll appeal again because the sentence imposed Thursday by Blair County Judge Elizabeth Doyle still amounts to a life sentence.

The (Altoona) Mirror says a three-judge Pennsylvania Superior Court panel upheld Helsel’s convictions, but ruled last month he must be resentenced because his prior 10-year sentence for raping two girls in the 1990s should have counted as just one conviction.

Doyle says she respectfully disagrees that Doyle’s current conviction, involving two other girls assaulted near an Altoona cemetery in 2009, amounts to only his second offense..
