Midday Briefing | VIDEO: Teens charged in grocery attack posted online

PHILADELPHIA — Three teenagers have been charged in a videotaped attack inside a Philadelphia supermarket that left a shopper with a broken nose and cheekbone.

The suspects were arrested after a video of the Saturday night attack turned up on YouTube. That video closely matched surveillance video detectives had posted on the Philadelphia Police Department's YouTube site as they sought tips, authorities said.

The surveillance video shows the 47-year-old victim being struck in the face as he tries to defend himself with his cart. He is then struck and kicked after falling to the ground, and robbed of a money clip containing $100.

Police on Wednesday charged 18-year-old Tomas Eanes and 17-year-olds Kevin Tavarez and Jose Ruiz, all of Philadelphia, with robbery, aggravated assault and other crimes. Tavarez and Ruiz have been charged as adults. A female suspect seen on the video is still being sought.

It's not immediately clear from court dockets if the suspects have lawyers.

Police don't yet know if or why the victim, who was shopping with his brother, was targeted.

The assault occurred at about 10 p.m. at a Pathmark store in Northeast Philadelphia.

Killer apologizes to kin of slain game warden

GETTYSBURG — A central Pennsylvania man convicted of killing a state game warden during a poaching investigation has apologized to the victim's family.

According to the Gettysburg Times, Christopher Johnson says he is sorry for the pain he has caused the relatives of wildlife conservation officer David Grove.

Johnson spoke Thursday during the penalty phase of his capital murder trial. After the hearing, a jury will decide whether he will be sentenced to death or life in prison.

Johnson was convicted earlier this week in Adams County of fatally shooting Grove in 2010.

Johnson lamented Thursday that there is nothing he can do to bring back Grove.

On Wednesday, the jury heard from friends and relatives of both Grove and Johnson.

Sandusky asks court to return wife's bail cash

STATE COLLEGE — Former Penn State assistant football coach Jerry Sandusky asked a judge Thursday to return $50,000 in cash to his wife and release their home, which was put up as collateral for $200,000 bail.

His lawyer, Joe Amendola, wants an order directing court officials to release the money and the claim on their home to Dottie Sandusky.

Sandusky, 68, has been in a county jail since his June conviction on 45 counts of child sexual abuse against 10 boys, some of them on campus.

He is expected to get a lengthy state prison term when sentenced next week, but he maintains his innocence and Amendola has said he will appeal.

Before the conviction, Sandusky had been confined to his suburban State College home. As an inmate at the Centre County Correctional Facility, Sandusky has been isolated from the general population of inmates.

Officials seize 400 video gambling machines

WILKES-BARRE — State and federal authorities have seized about 400 video gambling machines from locations across northeastern Pennsylvania.

State police said Thursday that authorities had raided 187 businesses in Luzerne, Lackawanna, Susquehanna and Wayne counties.

The seizures are linked to a two-year probe of illegal gambling led by Pennsylvania's Bureau of Liquor Control Enforcement and the Internal Revenue Service.

Police allege illegal gambling payouts were made to undercover enforcement officers. Charges are expected to be filed against a machine vendor and various bars that offered the games.

Officers from multiple agencies had been seen hauling away the gambling machines during coordinated seizures on Wednesday. But officials had refused to comment at that time.

Bon-Ton September revenue figure rises

YORK — Department store operator Bon-Ton Stores said Thursday that a key revenue figure rose 0.6 percent in September as it tightly managed its inventory and marketing efforts.

Total revenue for the five weeks ended Sept. 29 rose 0.7 percent to $288.9 million.

Year-to-date, revenue in stores open at least one year fell 0.1 percent, while total sales edged down 0.2 percent to $1.71 billion.

This metric is a key indicator of a retailer's health because it excludes results from stores recently opened or closed.

The best performing categories included jewelry, sportswear, dresses, shoes and women's large sizes. E-commerce sales rose in the double digits.

Bon-Ton, which has corporate offices in York, Pa., and Milwaukee, runs 272 department stores in the Northeast, Midwest and Great Plains states.

Its shares fell 20 cents, or 1.7 percent, to $11.76 in premarket trading.
